Lawyers to represent Aung San Suu Kyi in inheritance case

Chiang Mai (Mizzima ) – Burmese democracy icon Daw Aung San Suu Kyi gave civil power to her lawyers Nyan Win, Khin Htay Kywe and Hla Myo Myint yesterday to represent her against her elder brother Aung San Oo.

There is a dispute over ownership between Daw Aung San Suu Kyi and her elder brother Aung San Oo over the house where she lives. The Rangoon Divisional Court’s hearing on the case is scheduled for October 21.

“We asked for civil power from Daw Suu and got it yesterday. Now there is a panel of five lawyers. We shall present the case of inheritance on October 21,” Advocate Nyan Win told Mizzima.

Advocates Kyi Win, Myint Thaung, Aung Thein and Khin Maung Aye represented her in this case since 2000.

The regime revoked U Aung Thein’s advocate’s license for alleged professional misconduct under section 10(1) of the Bar Council Act. Advocate Khin Maung Aye died in 2007.

The case, Aung San Suu Kyi Vs Aung San Oo, started in 2000 and finally the court ruled that a foreigner was not entitled to ownership of property. Then Aung San Oo lost the case, Advocate Kyi Win told Mizzima.

In 2001 again, Aung San Oo’s lawyers filed another suit in administration of inheritance which has been pending till today.

In 2007, Daw Aung San Suu Kyi was not allowed to meet her witnesses in the case when they had to testify in court. The case has been pending.

Similarly her cousin brother retired Maj. Khin Maung Aye sold a part of the property on No. 54, University Avenue and his lawyers put a notice in the classified columns of the state-run daily papers on August 24 saying that objections can be made against the sale.

In the notice put up on the ‘instruction of the client’, his lawyers, higher grade pleaders (HGP) Cho The May and Wei Wei Aung did not mention the name of the buyer in the sale deed.

Khin Maung Aye is the adopted son of late Thakin Than Tun and Daw Khin Khin Gyi. He is also a writer and a retired army major. Daw Khin Gyi is the sister of Daw Aung San Suu Kyi’s mother Daw Khin Kyi.

Daw Aung San Suu Kyi sent her letter of objection to Khin Maung Aye’s lawyers saying the sale is unlawful on August 30. Advocate Nyan Win said that this case was unlawful and would not come up.

Though she planned to meet her lawyers yesterday, she had to meet the junta’s Liiasion Minister Aung Kyi instead at the Rangoon Green Bank guest house.

Today also, Daw Aung San Suu Kyi could not meet her lawyers, Nyan Win told Mizzima.
